These Terms govern your use of Apexcast — the desktop application and the apexcast.io website. They're written to be read, not skimmed.
By installing Apexcast or using apexcast.io, you agree to these Terms. If you don't agree, don't use the software or the site.
Apexcast Free is licensed to you free of charge, for personal or commercial use within the limits described on the Pricing page. The license is perpetual but is not granted with a right to redistribute.
Apexcast Pro is a perpetual personal license. You can activate it on up to three machines you personally own and use, but you can't share, sublicense, lease, rent, or resell it. Pro licenses are tied to the email address used at checkout.
Your projects, telemetry data, video footage, and exported renders are yours. We don't claim ownership and we don't have access to them — they live on your machine and are never uploaded to us.
Don't redistribute, resell, or sublicense Apexcast itself. Don't reverse-engineer or decompile it except to the extent expressly permitted by your local law (for example, interoperability under EU Directive 2009/24/EC).
Don't use Apexcast to do anything illegal — including processing footage that violates someone's privacy, reproduction rights, or applicable racing-event rules.
We may release software updates that change, add, or remove features. We try not to remove things people depend on, but we don't guarantee any specific feature will continue to exist in future versions.
Apexcast is in early release. It may crash, lose work that hasn't been saved, or fail to import or render specific files in ways we haven't yet caught. Keep backups of every project and every piece of footage you care about. Do not use Apexcast as the only copy of anything.
Apexcast is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions don't allow limits on implied warranties; in those, this section applies to the maximum extent permitted by law.
To the maximum extent permitted by law, Apexcast and the people who operate it are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost data, lost profits, or lost time.
Total liability under these Terms is capped at the amount you paid for your Pro license (currently $29) or, if you use Free, $0. This cap does not limit liability for things that cannot be limited under your local law, including gross negligence, willful misconduct, or non-waivable consumer-protection rights.
You can stop using Apexcast and uninstall it at any time. We may revoke your Pro license if you breach these Terms — especially the redistribution and reverse-engineering clauses. The refund policy continues to apply within its 30-day window.
We may update these Terms. Material changes are reflected with a new “Last updated” date at the top of this page. Continued use of Apexcast after a change takes effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Any dispute will first be addressed informally by emailing support@apexcast.io; if that fails, the state and federal courts located in Washington have exclusive jurisdiction. Nothing in this section removes any non-waivable consumer-protection rights you have where you live.
